Public Receivables

The assignment of credit rights held by states and municipalities now has an express legal basis. The transaction is possible; it remains more legal than financial.

Our view

Complementary Law 208/2024 added to Law 4,320/1964 rules for the paid assignment of credit rights held by federal, state and municipal entities, including those registered as outstanding tax claims (dívida ativa). This gives public entities an alternative way to bring revenue forward, subject to specific legal, fiscal and governance requirements.

The starting point is always a diagnosis of the portfolio: registry quality, recovery history, litigation and administrative collection capacity. Without that diagnosis, any structure is speculative. Fortevere has a dedicated practice in municipal receivables.
